There is no such thing as a "legal US online casino" in the abstract. Online casino gambling in the United States is regulated at the state level, and only seven states have opened a real-money interactive gaming market. Everywhere else, the answer is either "illegal", "not yet legal", or "legal only under the sweepstakes model". This piece is the map — state by state, with the regulator, the age rule, and the operational reality as of the third quarter of 2026.
The seven real-money states
Real-money online casino gaming is authorised and operational in seven US states. Each has its own regulator, its own licence framework, and its own tax and consumer-protection regime. If you are physically located in one of these states — verified by geolocation software at the operator's cashier — you can legally deposit and play for cash.
New Jersey (2013 — the founding market)
New Jersey remains the deepest and most competitive US online casino market. Regulated by the Division of Gaming Enforcement (DGE), the state licenses roughly two dozen distinct online casino brands, all operating in partnership with an Atlantic City land-based casino licence holder. Minimum age: 21. Payment rails include ACH, PayPal, Play+ prepaid, and cash-at-cage at partner casinos. NJ is the only state where every major national operator (DraftKings, FanDuel, BetMGM, Caesars, Borgata, Golden Nugget, Hard Rock, Bally's, Fanatics) is live simultaneously.
Pennsylvania (2019)
Pennsylvania Gaming Control Board (PGCB) oversees a market structurally similar to NJ, with licence tethering to land-based casino holders. Minimum age: 21. Slightly lower operator count than NJ, but the same top-tier national brands are present. Pennsylvania distinguishes itself with a specific "iGaming" tax structure — the highest online slot tax rate in the country at 54% — which shapes bonus economics on-market (bonuses are typically smaller and wagering requirements tighter than NJ).
Michigan (2021)
The Michigan Gaming Control Board (MGCB) opened a competitive online casino market in January 2021. Minimum age: 21. Uniquely, Michigan permits both commercial (Detroit-based) and tribal casino operators to hold online licences, giving the market a broader distribution of brands than most peers. Michigan's ACH payout medians have historically been the fastest in our audit — a market-structure artefact rather than a coincidence, because tribal operators run their own bank rails without the same intermediary layers.
West Virginia (2020)
West Virginia Lottery regulates the state's online casino market. Minimum age: 21. Smaller operator count (five licensed brands as of late 2026), but the state's regulatory posture is consistently player-friendly on payout speed and dispute resolution. West Virginia is one of only two states where the regulator publishes complaint resolution timelines publicly.
Connecticut (2021)
Connecticut's online casino market is a two-operator exclusive: DraftKings (partnered with Foxwoods) and FanDuel (partnered with Mohegan Sun). No other brand can legally operate an online casino in Connecticut. Minimum age: 21. The narrow market means less competition and, empirically, tighter bonus structures than the open markets.
Rhode Island (2024)
Rhode Island became the sixth real-money online casino state in early 2024. Bally's holds the state's sole online casino licence via its Twin River property. Minimum age: 18 — one of only two states in the country where the online casino age matches the state's general gambling age rather than the higher casino-specific threshold. Small market, single operator, but genuinely legal.
Delaware (2013 — the other founder)
Delaware was the first US state to authorise online casino gaming, but the market has remained the country's smallest. Regulated by the Delaware Lottery, the state runs a single-vendor platform serving all three of its casino licence holders. Minimum age: 18. Delaware in 2026 is a proof-of-concept market more than a competitive one, but the licences are real and the operators are legally accountable to state regulators.
The states that authorise online sports betting but not casino
A recurring confusion: many US states have legalised online sports betting without legalising online casino gaming. New York, Illinois, Ohio, Virginia, Tennessee, Kentucky, and roughly two dozen others fall into this category. In these states, real-money online casino play is not legal. Residents who use offshore casino sites are not legally protected by any US regulator if a dispute arises.
The sweepstakes model — legal in 45 states
Everywhere except Washington, Idaho, Nevada, Michigan, and Montana (and with narrower restrictions in Connecticut and New York), the sweepstakes casino model operates as a legally distinct product. Sweepstakes casinos are not regulated as gambling because, technically, they are not gambling — they operate under state-by-state sweepstakes and promotional law, using a dual-currency system that separates the entertainment currency from the redeemable currency.
We wrote a separate deep dive on how the dual-currency model actually works. The short version: you buy "Gold Coins" (entertainment only, non-redeemable), receive "Sweeps Coins" as a promotional inclusion, play games with either, and redeem accumulated Sweeps Coins for cash prizes. Because the "consideration" element of the traditional gambling definition is technically absent — the promotional currency is free — the product operates under sweepstakes law rather than gambling law.
Minimum age for sweepstakes casinos: 18 in most states, 21 in a handful. Payment rails include ACH, Skrill, and cryptocurrency depending on operator.
How to actually verify a US casino is legal where you are
- Check the operator's licence page. Every real-money operator lists its licence number on its footer. Cross-reference against the state regulator's public licensee list (DGE in NJ, PGCB in PA, MGCB in MI, WV Lottery, CT DCP, RI Lottery, DE Lottery).
- Watch the cashier geolocation check. Legitimate real-money operators check your GPS on every login and every deposit. If a site accepts your deposit from a non-regulated state without a geolocation check, the site is not operating under any US licence — regardless of what its homepage says.
- Look for the age gate. 21+ in NJ, PA, MI, WV and CT. 18+ in RI and DE. If the operator's age gate does not match the state you are in, the operator is not compliant with that state's regulator.
Where the map goes next
New York's legislature has now introduced online casino authorisation bills in three consecutive sessions. Maryland has done the same. Illinois debated a bill in 2025 that died in committee. None of these markets has crossed the finish line as of Q3 2026, but the pipeline is real, and the next 12 to 24 months are likely to add at least one, possibly two, new real-money states. When they do, we will update this guide.
Until then, the answer to "is online casino legal in my state" is answered honestly by looking at the map above, not by looking at an offshore casino's homepage.
